Gift Vouchers Terms & Conditions

Applies To: All Gift Cards and Gift Certificates from ELM Photo Co.

By purchasing or receiving a Gift Card (Gift Certificate or Gift Voucher) from ELM Photo Co., you agree to abide by the following Terms & Conditions:

1. E-Gift Cards: If you order an e-gift card and wish to get a physical certificate, please contact us and we are happy to provide one at no additional cost. It can be mailed, picked-up, or dropped-off.  
2. Gift Vouchers may only be redeemed in exchange for the package or value printed on the front of the Gift Voucher.
3. Redemption: Valid only for ELM Photo Co. photo sessions.
4. Exclusions: NOT valid for use towards prints or physical products.
5. Non-Refundable: Cannot be returned, refunded, or redeemed for cash unless required by law.
6. Overages: Any costs exceeding the Gift Card's face value (such as upgraded print collections or extra digital files), or session costs above the value of the Gift Card, are the client's responsibility.  If the gift certificate balance is insufficient to cover the full cost of a session fee, a "split tender transaction" may be processed, allowing you to pay part with the gift certificate and the remainder with another accepted payment method. 
7. Advance Notice: Sessions must be booked in advance, subject to the ELM Photo Co.'s availability.
8. Gift Vouchers should be treated as cash - ELM Photo Co. accepts no liability for lost, stolen or damaged Gift Vouchers.
9. Lost or Stolen Certificates: Client agrees to take all reasonable precautions to protect the gift certificate. If the gift certificate is lost or stolen, please immediately contact ELM Photo Co. We will cancel the original certificate and issue a new one if the balance can be verified.  
10. ELM Photo Co. will only accept use of the Gift Voucher upon presentation of the original Gift Voucher. Copies will not be accepted.
11. Gift Vouchers cannot be traded for or used to purchase another Gift Voucher.
12. ELM Photo Co. maintains full intellectual property rights to all images produced during the Gift Voucher photography session.

Using your Gift Certificate: You may redeem your Gift Voucher at www.elmphotoco.com and when booking your session. When you use your Gift Voucher, the amount of your purchase will be deducted from the balance on the Certificate. The remaining balance may be applied to future purchases. We reserve the right to refuse to accept Gift Certificates which we believe may have been stolen or obtained in another illegal way. 

Photography Contract Required:  All Gift Voucher holders must sign a legally binding photography contract with ELM Photo Co., before any photography services will be administered. Without contract signed, Gift Voucher holder does not have the rights to any services provided by ELM Photo Co., and does not have the right to use Gift Voucher in exchange for any ELM Photo Co. photography sessions, or for any monetary refunds. 

Refusal of Service: ELM Photo Co. may refuse service where provision of services would, in our opinion, negatively affect the workplace rights, safety or well being of our Staff or Clients, or cause an unreasonable disruption to our normal operations. This includes any issues of abuse or disrespect (whether emotionally or physically) by client towards any of our ELM Photo Co. staff members.  If this happens, then gift certificate, print credit and any other offers pertaining to gift certificate will be forfeited and withdrawn from client use, and client will not hold ELM Photo Co., its staff members and heirs liable in any way for amount of gift certificate.  If you are refused services due to issues stated above, you then forfeit any rights to gift certificate, photo-session & print credit offered. 

All Rights Reserved: ELM Photo Co. reserves the right to amend these Gift Voucher terms and conditions from time to time, at our sole discretion.  In the event of any dispute, the decision of ELM Photo Co. is final.  All terms and conditions are applicable to the extent permitted by British Columbia Provincial Law.
